The Municipal Corporation of Delhi (MCD) has approved the creation of 58 additional posts of special educators in its primary schools to improve learning support for children with disabilities.
The decision comes following directions from the Delhi High Court to address gaps in recruitment under the Economically Weaker Sections (EWS) quota. Officials said the new positions will be created as additional posts to ensure that candidates already selected or placed on waiting lists are not affected.
The civic body has allocated about Rs 4.6 crore annually to fund the newly sanctioned positions.
Recruitment gap triggered the move
The issue stems from a recruitment drive conducted in 2020–21 by the then South Delhi Municipal Corporation, in which 1,126 posts of special educators for primary schools were advertised.
The vacancies were sent to the Delhi Subordinate Services Selection Board for conducting examinations and finalising appointments. However, only 54 posts were notified under the EWS category, even though the quota required around 112 posts — equivalent to 10 per cent reservation.
The shortfall led to concerns among aspirants who argued that the reservation policy had not been properly implemented.
Legal challenge and court ruling
A group of candidates approached the Central Administrative Tribunal, contending that the EWS reservation introduced through constitutional amendments in 2019 had not been fully followed.
The tribunal directed authorities to review the recruitment and ensure full implementation of the reservation policy. The order was later challenged before the Delhi High Court, which upheld the tribunal’s decision and dismissed the petition.
The High Court also directed that the required posts be created as supernumerary positions so that fresh appointments would not impact candidates already selected or those on waiting lists.
Compliance with EWS reservation policy
The EWS reservation in government jobs was introduced through the 103rd Constitutional Amendment Act, providing 10 per cent quota in direct recruitment, including teaching positions.
Officials said the creation of 58 additional posts will bridge the earlier shortfall and bring the recruitment process in line with reservation norms.
The Municipal Corporation of Delhi is expected to begin the recruitment process for the new positions in accordance with the court’s directions.
